Rape Law Atlas: classical doctrine against sixteen penal codes

How do rape laws in sixteen Muslim-majority countries relate to classical Islamic jurisprudence (fiqh)? Seven core questions on how the crime is defined, proved and punished, and who it protects.

The law is stated as of October 2026, from the public sources listed at the end. This is an educational comparison, not legal advice. The scores measure distance from the classical framework, not how well a system protects victims; in some respects classical law protected victims better than modern statutes.

Each country's seven scores summed (maximum 21). Most countries replaced classical criminal law with French, British or Ottoman penal codes in the 19th and 20th centuries and never brought it back. Only Afghanistan under the Taliban, Iran and Saudi Arabia apply the classical framework to rape today.

The classical baseline

What classical fiqh said about rape

Classical jurists treated rape as zinā bil-ikrāh, unlawful intercourse by coercion. The man faced the fixed (ḥadd) penalty for zinā. Jurists agreed the coerced woman was not punished, relying on the Prophet's statement lifting liability for what is done under compulsion. Some jurists, mainly Maliki, classed violent or armed rape as ḥirāba (armed robbery and terror), which carries death.

The ḥadd required four male eyewitnesses or a confession. Where that proof was missing, judges could still punish under discretionary taʿzīr using other evidence. Maliki, Shafiʿi and Hanbali jurists also made the rapist pay the victim a fair dower (mahr al-mithl) as compensation. The Hanafi school disagreed.

Two cautions in the classical record

Maliki law treated pregnancy of an unmarried woman as evidence of zinā unless she could show coercion. Where that rule was applied in modern law, as in Pakistan from 1979 to 2006, it put victims at risk of prosecution.

Fiqh had no concept of rape within marriage. Harm to a wife was prohibited, compensable and a ground for divorce, but not a crime of rape.

Marriage as an escape from prosecution

“Marry your rapist” rules came from European codes, not fiqh

Several Arab penal codes let a rapist or abductor escape prosecution by marrying the victim. Classical fiqh has no such defence: a ḥadd could not be waived once it reached a judge. The rule entered through the French Penal Code of 1810 and the Ottoman Penal Code of 1858. Two of the sixteen countries still have it.

Maximum penalty

Death is available in nine of sixteen countries

The most severe sentence the law allows for rape of an adult or child, aggravated forms included. In the classical framework death applied to a married offender (by stoning) or to rape treated as ḥirāba.

Comparative analysis

Patterns across sixteen systems

1. Criminal law was secularised far more than family law

In family law, fourteen of sixteen countries kept the classical structure. For rape, thirteen of sixteen use statutory penal codes descended from French, British or Ottoman models. Iran (1979, codified 2013), Saudi Arabia (never codified) and Taliban-ruled Afghanistan (2021) are the exceptions.

2. Pakistan shows the cost of the four-witness rule

The 1979 Zina Ordinance put rape inside the ḥadd framework. A victim unable to produce four witnesses could be prosecuted for zinā on her own complaint. The Protection of Women Act 2006 moved rape back to the Penal Code and barred converting a rape complaint into a zinā case.

3. Marital rape is the shared gap

Only Turkey and Indonesia clearly criminalise rape within marriage; Tunisia's 2017 law defines rape "whatever the relationship" between the parties. Jordan and Bangladesh exclude wives in the text itself. On this question the statutes and classical fiqh both leave wives unprotected.

4. Classical law offered a remedy most statutes lack

Three Sunni schools required the rapist to pay the victim a fair dower. Iran keeps this (mahr al-mithl plus compensation for loss of virginity). Most statutory codes leave compensation to a separate civil claim that victims rarely pursue.

5. Zinā offences still endanger victims

Where consensual sex outside marriage is a crime, as in Morocco (Art 490), Saudi Arabia, Iran and Afghanistan, a victim who cannot prove force may be treated as a confessing offender. The UAE's 2021 code made adult consensual sex a complaint-only offence, which lowers this risk.

6. Reform is moving fast in some places

Bangladesh's 2025 amendment covers perpetrators of any gender and boys under 16, and shortens investigations to 15 days. Kuwait repealed its abductor-marriage article in 2025, and Indonesia's new Criminal Code took effect in January 2026.

How the scores were assigned

The baseline is the shared core of the Sunni schools, with Maliki and Hanafi differences noted; Iran follows Jaʿfari doctrine, which is close on these questions. Each country gets 0–3 per issue: 0 the classical rule is applied; 1 a classical framework with statutory overlay; 2 a statutory rule that keeps classical features (zinā offences, corporal punishment, a husband's immunity framed in religious terms); 3 a fully statutory rule. Where a country has regional regimes (Aceh in Indonesia, Malaysian state Syariah codes) the score reflects the national rule and the note names the exception.

A high score does not mean a system protects victims better. Marital exemptions, for example, score low because fiqh also lacked the concept, while the marriage-to-rapist exemption is shown separately because it has no basis in fiqh.
